Privacy Policy

Colvard Learning, LLC ("we" or "us") knows that you care how information about you is used and shared, and we appreciate your trusting us to do so carefully and sensibly. We take your privacy very seriously and make it a priority to protect personally identifiable information. Colvard Learning provides mobile apps/software across a variety of devices and platforms. Our apps and any other features, tools, materials, or other services offered from time to time by Colvard Learning in connection with our business, however accessed, are referred to collectively as the "Colvard Learning Content.” Use of Colvard Learning Content is subject to compliance with any end user license agreement that might accompany a Colvard Learning application, feature or device.

For our consumer mobile products, Colvard Learning does not request any personally identifiable information. Some of our mobile apps may ask you to enter user names to track child progress through the app, however, this information is only stored locally on the device as is not transmitted to any on-line server or cloud-based storage facility.

For educational institutions, we collect information necessary for licensing transactions. These may include credit card information and contact e-mail, addresses and phone numbers of administrators and/or purchasing agents. Usernames and passwords of teachers and other school administrators are retained in the normal course of product and classroom registration. We also store any classroom information, including student names, that a teacher may enter, and potentially any student performance metrics. Colvard Learning reserves the right to distribute or share aggregated performance metrics that are not connected to, or identifiable with, any particular student, classroom, teacher or school.

Colvard Learning may automatically receive and record information from your computer, browser and the use of our apps, including your IP address, software and hardware attributes, the page you request, UDID, and cookie information, as such data would be transferred in the normal course of accessing any website.

Colvard Learning does not share any information, be it personally identifiable or not, with any 3rd party vendors, other users of our products or any other entities, with the possible exception of aggregated, non-identifiable performance metrics as mentioned above.

There may be instances when we may disclose personally identifiable information without providing you with a choice in order to protect the legal rights of Colvard Learning or its affiliates, and each of their respective investors, directors, officers, employees, agents, and suppliers; to protect the safety and security of users of the Colvard Learning Content; to protect against fraud or for risk management purposes; or to comply with or respond to the law or legal process or a request for cooperation by a government entity, whether or not legally required.

If you notify us that you believe your legal rights have been violated by Colvard Learning, we may provide the information that you provide to us to others to the extent that we believe it is necessary to evaluate and respond to your complaint.

If we sell all or part of our business, or make a sale or transfer of assets, or are otherwise involved in a merger or business transfer, or in the unlikely event of bankruptcy, we will transfer your personally identifiable information to one or more third parties as part of that transaction.

We use reasonable physical, technical, and administrative measures to safeguard personally identifiable information in our possession against loss, theft and unauthorized use, disclosure, or modification. We also take steps to ensure that only those Colvard Learning employees, agents, and contractors who have a legitimate business reason to obtain access to your personally identifiable information are granted access.

Despite these efforts, please note that no data storage can be guaranteed to be 100% secure. We want you to feel confident using the Colvard Learning Content but we cannot ensure or warrant the security of any information you transmit to us. Colvard Learning Content is intended to be purchased by parents and other adults. As such, the Colvard Learning Content is not marketed directly to children under 18 years of age. We do not knowingly collect personally identifiable information from children under 13 years of age. If a parent or guardian becomes aware that his or her child has provided us with personally identifiable information without their consent, he or she should contact us at support@colvardlearning.com. If we become aware that a child under 13 years of age has provided us with personally identifiable information, we will delete such information from our files.

From time to time, we may revise this Privacy Policy to reflect industry initiatives or changes in the law or to the scope of the Colvard Learning Content or for other reasons. Therefore, it is important to check the effective date of the Privacy Policy posted at http://www.colvardlearning.com/privacy-policy.html each time you visit the Colvard Learning Site or use any of the Colvard Learning Content to ensure you are familiar with the most updated policies and practices. If we make any material revisions to this Privacy Policy, we will notify you by posting notice on the Colvard Learning Site. If the material revisions concern practices where we have represented that we will obtain your consent to use or disclose your personally identifiable information, we will obtain your consent before taking any action inconsistent with those representations.
